About R&TTE
Radio equipment is defined as a product or relevant component thereof capable of communication by means of the emission and/or reception of radio waves utilising the spectrum allocated to terrestrial/space radio communications.
Telecommunications terminal equipment is defined as a product enabling communication or a relevant component thereof which is intended to be connected directly or indirectly by any means whatsoever to interfaces of public telecommunications networks.
Essential Requirements
Article 4 of the Rulebook on R&TT equipment stipulates for R&TT equipment to fulfil the following Essential Requirements:
1) protection of the health and safety of the user and any other person, including the essential requirements with respect to safety pursuant to separate regulation, regulating electrical equipment designed for use within certain voltage limits (LVD),, but with no voltage limit applying;
2) electromagnetic compatibility contained (EMC) regulated by a separate regulation;
3) efficient spectrum usage.
Additional R&TT Equipment Requirements
Article 5 of the Rulebook on R&TT equipment stipulates for specific R&TT equipment classes and subclasses to fulfil the following additional requirements:
- it interworks via networks with other equipment and can be connected to interfaces of the appropriate type;
- it does not harm the network or its functioning or misuse network resources, thereby causing an unacceptable degradation of service;
- it incorporates safeguards to ensure that the personal data and privacy of the user and of the subscriber are protected;
- it supports certain features ensuring avoidance of fraud;
- it supports certain features ensuring access to emergency services;
- it supports certain features in order to facilitate its use by users with a disability.
Placing R&TT equipment on the market, within the meaning of Art. 3 item 12) of the Rulebook on R&TT equipment, shall mean to make available the equipment in the market of the Republic of Serbia for the first time, for the purpose of distribution or usage, with or without charge.
R&TT equipment may be freely placed on the market and/or put into service in the Republic of Serbia, provided it complies with the requirements referred to in Arts. 4 and 5 hereof and other conditions stipulated under Rulebook on R&TT equipment, if installed, maintained and used in accordance with its intended purpose.
R&TT equipment which does not comply with some of the requirements referred to in Arts. 4 and 5 hereof or other requirements and conditions, may be displayed and presented in fairs, expositions or other similar manifestations, provided that such equipment bears a visible and clear marking that it may not be placed on the market nor be used in the Republic of Serbia. Public display and presentation of such equipment shall be possible only if the appropriate measures for EM interference prevention have been previously taken.
The manufacturer, their representative or the importer of R&TT equipment, in case the manufacturer or their representative are not registered in the territory of the Republic of Serbia, shall provide the following together with the product:
- User manual in Serbian language,
- Technical characteristics of the equipment;
- Data on types of interfaces to which the equipment can be connected,
- Affixed warning on possible limitations to radio equipment usage and/or the need to procure a permit for radio frequency usage,
- Declaration of Conformity and/or a certified photocopy of the original EC Declaration of Conformity along with the translation into Serbian language.
The manufacturer, their representative or the importer of R&TT equipment, in case the manufacturer or their representative have not been registered in the territory of the Republic of Serbia, may make available on their official website the Declaration of Conformity and/or a certified photocopy of the original EC Declaration of Conformity along with the translation into Serbian language, whereby they shall include the website address in the R&TT equipment user manual.
When being placed on the market of the Republic of Serbia, R&TT equipment shall bear the conformity mark referred to in Art. 19 herein, pursuant to Appendix 7 of the Rulebook on R&TT equipment.
Putting of R&TT Equipment into Service and the Right to Connect to the Network
Putting of R&TT equipment into service, within the meaning of Art. 3, item 13) of the Rulebook on R&TT equipment, shall mean the first usage of the equipment for its intended purpose in the Republic of Serbia.
R&TT equipment may be put into service according to its intended purpose provided it fulfils the requirements and other conditions stipulated under the Rulebook on R&TT equipment.
Certificate of Conformity
Prior to placing the R&TT equipment on the market, the manufacturer, their representative or the importer of R&TT equipment in case the manufacturer or their representative have not been registered in the territory of the Republic of Serbia, shall submit to the Agency, as thenominated body for conformity assessment, a copy of Declaration of Conformity of the equipment, or a certified photocopy thereof, together with the accompanying technical documentation, for the purpose of conformity verification of the R&TT equipment with the requirements under the Rulebook on R&TT equipment.
The Agency, as the nominated body for conformity assessment, shall keep the Register of the issued Certificates of Conformity, publish it on their official website and issue an Excerpt from the Register at the request of the manufacturer or their representative or importer, in case the manufacturer and their representative are not registered in the territory of the Republic of Serbia.
Based on the Certificate of Conformity or the Excerpt from the Register of the Issued Certificates of Conformity, the manufacturer or their representative or the importer of R&TT equipment in case the manufacturer or their representative have not been registered in the territory of the Republic of Serbia, shall affix the Serbian conformity mark to the R&TT equipment.
The Certificate of Conformity shall be procured when importing R&TT equipment. It is sufficient for the importer to procure the Certificate of Conformity or the Excerpt from the Registry of the Issued Certificates of Conformity, as preferred, and present it to the customs authorities. The importers are advised to procure the aforementioned documents before the goods arrive in the customs area of the Republic of Serbia.
All foreign manufacturer or their representatives in the Republic of Serbia, and/or importers of R&TT equipment, intending to place R&TT equipment on the market, are strongly advised to submit the application for the issuance of the Certificate of Conformity (together with the required documentation) for the goods they intend to place on the market, in timely manner and prior to the intended placing of good on the market. This is to enable a timely issuance of the Certificate of Conformity and prevent unnecessary keeping of goods, thereby eliminating any additional costs (storage charges, demurrage, etc.).
