Coming into force of the Rulebook on the application of fair use policy and on the methodology for assessing the sustainability of the abolition of retail roaming surcharges and on the application to be submitted by a roaming provider for the purposes of that assessment

The Regulatory Authority for Electronic Communications and Postal Services – RATEL, within its prescribed competencies, adopted the Rulebook on the application of fair use policy and on the methodology for assessing the sustainability of the abolition of retail roaming surcharges and on the application to be submitted by a roaming provider for the purposes of that assessment ("Official Gazette of RS", No. 42/2024 of May 9, 2024) which entered into force on May 17, 2024.

This Rulebook regulates the application of a fair use policy that a business entity, as a provider of roaming services in public mobile communication networks (hereinafter: the roaming provider), may use in terms of consumption of regulated retail roaming services provided at the applicable domestic retail prices, the methodology for assessing the sustainability of the abolition of retail roaming surcharges, which RATEL shall apply when assessing whether the roaming provider is able to recover the costs of providing regulated roaming services, with the effect that the sustainability of its domestic charging model would be undermined, as well as the application to be submitted by the roaming provider, along with the necessary data, to RATEL for the purpose of the assessment, i.e. for the authorisation to apply a roaming surcharge.
