About radio equipment
Radio equipment is an electrical or electronic product that intentionally emits and receives radio waves for the purpose of radio communication and/or radio determination, or an electrical or electronic product that must be supplemented with auxiliary equipment, such as an antenna, in order to intentionally emit and/or receive radio waves for the purpose of radiocommunication and/or radiodetermination.
Essential radio equipment requirements
Article 4 of the Rulebook on radio equipment prescribes that radio equipment must fulfill the following requirements:
1) protection of health and safety of people and domestic animals and protection of property, including essential safety requirements in accordance with a special regulation governing electrical equipment designed for the use within certain voltage limits, but with no voltage limit applying;
2) electromagnetic compatibility contained (EMC) governed by a separate regulation;
Radio equipment shall be designed to make effective use of the radio frequency spectrum and support its efficient use to avoid harmful interference.
Radio equipment in certain categories or classes shall be designed to comply with the following essential requirements:
1) it interoperates with accessories other than charging devices for categories or classes of radio equipment referred to in Article 4, paragraph 4, and Part I of Annex 11 to the Rulebook on radio equipment;
2) it interworks via networks with other equipment;
3) it can be connected to interfaces of the appropriate type;
4) it does not harm the network or its functioning or misuse network resources, thereby causing an unacceptable degradation of service;
5) it incorporates safety measures to ensure the protection of user and subscriber personal data and privacy;
6) it supports certain features ensuring avoidance of fraud;
7) it supports certain features ensuring access to emergency services;
8) it supports certain features in order to facilitate its use by users with a disability;
9) it supports certain features to ensure that software can be loaded into radio equipment only if the compliance of the combination of radio equipment and software has been demonstrated.
Radio equipment included in the categories or classes listed in Part I of Annex 11 to the Rulebook on radio equipment shall be manufactured in such a way as to comply with the specifications relating to the charging capabilities set out in that Annex for the relevant category or class of radio equipment.
The essential requirement referred to in Article 4(3)(4) of the Rulebook on radio equipment shall apply to radio equipment capable of establishing communication via the Internet, whether such communication is direct or through any other equipment (hereinafter: Internet-connected radio equipment).
The essential requirement referred to in Article 4(3)(5) of the Rulebook on radio equipment shall apply to the following radio equipment if such radio equipment is capable of processing personal data within the meaning of the law governing the protection of personal data or traffic data or location data under the law governing the field of electronic communications:
1) Internet-connected radio equipment, not included in items 2)-4);
2) radio equipment designed or intended exclusively for child care;
3) radio equipment covered by the regulation governing the safety of toys;
4) radio equipment designed or intended to be carried, attached or hung on:
(1) any part of the human body, including the head, neck, torso, arms, hands, legs and feet;
(2) any clothing, including clothing covering the head and arms or footwear, worn by people.
The essential requirement from Article 4, paragraph 3, item 6) of the Rulebook on radio equipment shall apply to all Internet-connected radio equipment if that radio equipment enables the owner or user to transfer money, monetary values or virtual currency.
The essential requirements from Article 4, paragraph 3, items 4)-6) of the Rulebook on radio equipment shall not apply to radio equipment governed by the regulation applicable to medical devices.
The essential requirements from Article 4, paragraph 3, items 5) and 6) of the Rulebook on radio equipment shall not apply to radio equipment governed by the regulations applicable to:
1) motor vehicle and trailer homologation;
2) electronic toll collection method, specific conditions and technical requirements for European electronic toll collection and interoperability elements.
The essential requirement referred to in Article 4, paragraph 3, item 7) of the Rulebook on radio equipment shall apply to mobile phones with functions similar to those of a computer in terms of the ability to process and store data. Compliance with this requirement is ensured by technical solutions for receiving and processing data from wireless local area network signals (WLAN/Wi-Fi) and data from global navigation satellite systems, compatible and interoperable at least with the Galileo system, as well as by technical solutions enabling the transmission of such data in communication with emergency services.
Delivery to the market
Radio equipment is delivered to the market of the Republic of Serbia in accordance with the requirements and conditions of the Rulebook on radio equipment.
Commissioning and putting into service
Radio equipment may be commissioned and put into service in accordance with the requirements and conditions of the Rulebook on radio equipment, provided that it is properly installed, maintained and used in accordance with its intended purpose.
Free movement of radio equipment
Radio equipment that complies with the requirements and conditions of the Rulebook on radio equipment shall be freely placed on the market of the Republic of Serbia, without any restrictions.
Radio equipment that does not comply with the provisions of the Rulebook on radio equipment may be publicly displayed and presented at fairs, exhibitions and similar events in the Republic of Serbia, only with a clearly and visibly displayed sign indicating that the placing on the market or putting into service of such equipment is not permitted in the Republic of Serbia. Such radio equipment may be publicly presented only if appropriate measures have been taken to avoid harmful interference, electromagnetic disturbances and risks to the health or safety of persons, domestic animals and property.
Certificate of Conformity
Before placing radio equipment on the market, the manufacturer, their representative or the importer of that radio equipment shall obtain from the body responsible for assessing the conformity of radio equipment with the essential requirements referred to in Article 4 of the Rulebook on radio equipment, a certificate of conformity or an extract from the records of issued certificates of conformity.
A certificate of conformity or an extract from the records of issued certificates of conformity shall be provided for the following radio equipment:
1) user equipment operating within GSM/UTRA/E-UTRA/NRA IMT cellular networks;
2) unspecified short-range devices (SRD);
3) short-range devices (SRD) for locating, tracking and collection of data;
4) wide-area network systems (WAS/RLANs);
5) for railway applications;
6) for transport and traffic telematics (TTT);
7) for radiodetermination applications;
8) alarms;
9) for model control applications;
10) for inductive applications;
11) radio microphones, hearing aids and wireless audio and multimedia streaming systems;
12) for radio frequency identification (RFID) applications;
13) active medical implants and associated peripherals;
14) to collect medical data.
The certificate of conformity, or an extract from the records of issued certificates of conformity, shall not provided for the specified radio equipment if the conformity assessment procedure referred to in Annex 2 and Annex 3 of the Rulebook on radio equipment has been carried out for that radio equipment in the Republic of Serbia for all aspects of the essential requirements.
The certificate of conformity is valid for the same type and/or model of radio equipment from the same manufacturer for five years from the date of its issuance.
It is recommended that foreign manufacturers, or their representatives in the Republic of Serbia, or importers of radio equipment, submit a request for the issuance of a certificate of conformity (with the prescribed documentation) to the designated conformity assessment body for the radio equipment they intend to place on the market of the Republic of Serbia, in a timely manner, prior to the intended placement on the market. This would enable the timely issuance of a certificate of conformity and avoid unnecessary retention of the product, thus eliminating additional costs (storage costs and charges, etc).
Conformity marking
Radio equipment that complies with the essential requirements shall be marked with the Serbian conformity mark before being placed on the market.
The conformity mark shall be affixed to the radio equipment or its nameplate in a visible, legible and indelible manner, and if this is not possible or not justified due to the characteristics of the radio equipment, to its packaging or accompanying documentation.
The Serbian conformity mark shall be accompanied by the registration number of the designated body from the register of designated bodies for conformity assessment, as well as the last two digits of the year of issue of the conformity certificate, if that body carried out or participated in the conformity assessment.
Assessment of radio equipment conformity
In accordance with the provision of Article 32, paragraph 1 of the Rulebook on radio equipment ("Official Gazette of the Republic of Serbia", No. 24/24, hereinafter: the Rulebook on radio equipment), the Regulatory Authority for Electronic Communications and Postal Services (hereinafter: the Regulator) shall continue to perform the tasks of radio equipment conformity assessment on the basis of the Decision of the Minister of Culture and Information Society, No. 119-01-00168/2011-06 of 29 May 2012 and the Conclusion on the correction of errors in the Decision on the designation of the Republic Agency for Electronic Communications as a conformity assessment body, No. 119-01-00168/2011-06 of 22 June 2012.
The manufacturer, its representative or importer, if the manufacturer or its representative is not registered in the territory of the Republic of Serbia, before placing on the market the radio equipment referred to in Article 20, paragraph 2 of the Rulebook on radio equipment, shall submit to the Regulator a request and the prescribed technical documentation for the purpose of issuing a Certificate of Conformity, in the manner and method regulated by the Procedure for performing conformity assessment tasks for radio equipment, adopted by the Director of the Regulator on 12.6.2024, under number 1-01-3404-2/24.

The applicant for assessment of radio equipment conformity is obliged to pay the costs of conformity assessment and issuance of a certificate of conformity and/or an extract from the records of issued certificates of conformity, in the amount set by the Rulebook on the amount and method of payment of fees for the provision of services within the competence of the Regulatory Body for Electronic Communications and Postal Services ("Official Gazette of the Republic of Serbia", Nos. 92/24 and 95/24).
